IMPORTANT!! We have been innovators in this industry for the last 6 years and if you want to copy ANYTHING on our website you MUST ask for permission. Most of our information is written by our staff and techs, photos are OUR photos, articles are ours, the LOOK AND FEEL including the shopping software we use is under copyright. If any of our information, videos, web text and photos, shopping software, etc, is taken without written permission you will be in direct violation of our copyrights and will be persued to all extent of Federal Laws. Disclaimer about Years and MCO's for vehicles. Unless the year is stated on the product page, the vehicle year WILL vary. Chinese VIN's typically run a year behind the US calander. So if it is year 2010, you might get a 2008 or 2009. In some cases the paperwork could also state 2007. This is why we do not list the year because it varies from container to container. ALL our units are brand new in the crate when they are sold. If the year is important to you, you MUST ask before you purchase the unit. Once the unit has been shipped, if you want to return it because of the year, you, the customer, will be responcible for the shipping costs to and from your address as well as the restocking fees.

Binding AgreementThis means that if you go to any page on our site or buy a product then you agree to the following terms and are in a binding agreement with Killer Motorsports, INC. These are our terms and policies as a company an ANY customer who makes a purchase from our company (online or offline) are subject to these terms and policies.
Privacy PolicyWe do not sell or share any information we receive from customers. When you buy something from Killer Motorsports, you can opt to be included in OUR mailing list for promotional mailers and emails. Security Our website uses Secure Sockets Layering (SSL) with 512bit encryption. We are also covered by Volusion 256bit SSL Security Protection. It's pretty much impossible anyone would be able to get your information. Important Limitations on your rights All of your rights will be used only in a lawful way and without breaching the peace. I, as buyer, have carefully read the foregoing and acknowledge that I understand and agree to all the Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the affect of the same. I, as buyer, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release all legal rights that I may have or possess. I, as buyer, therefore release all liability and waive all Legal rights I may have in with any items purchased from Killer Motorsports. Any and all issues or problems will be solved in accordance to the terms specified in this contract. Holding Units We can only hold units if a 20% deposit is put down. We can then only hold the unit for 48 hours. If the unit is not picked up within 48 hours and paid in full we have the right to sell the unit and retain the deposit. We will NOT hold a unit unless a deposit is put down. Colors We try and do a good job of describing the colors and what the bikes look like. Sometimes we are out of one color so that is why we ask for an alternate color. In case we are out of that color we can get you another color and still get your bike out to you! Changes and Inaccuracies We are constantly improving our website and are always striving to get the best descriptions made that are 100% accurate as well as current pictures. Sometimes we do get some bad information from the manufacture. We will in NO WAY PERIOD refund money or accept returns for inaccuracies. If you are buying something on the internet and are concerned the description could be wrong, we have a full staff that can answer questions via email, phone, or at the shop in person before you buy. You, the customer, acknowledges this and agrees to these terms and agreements as stated. Prices are subject to change at any time. Once your order is placed there are no refunds ore reimbersments made if we change prices after you place your order for any circumstance.
For our ATVS: We sell generic Chinese ATVS and source our atvs from many sources. Many importers will purchase units from other importers while waiting to be restocked and will send us those perspective unit to fulfill our orders. If a customer were to order a JCL, Tao Tao, etc and receive a Roketa Coolster, etc, this is coming from the same chinese factory, but will have been imported by someone different and will have their stickers on that unit. This is very common as chinese manufactures and importers change so frequently. We purchase units from many different importers that all import from the same chinese factory, this will ensure we can provide parts for all the units we sell. If a Coolster is ordered a JCL, Tao Tao, or Roketa might be receieved instead. This is coming from the same chinese factory, however it is imported by a different distributor and will have that distributors sticker kit and name on it. If you have any questions regarding this, please let us know. We make our best effort to send the "brand" that was ordered but if that "brand" is not in stock, an alternate "brand" aka, distributors unit, might be sent to fulfil the order. If the same type unit cannot be sent out, we will call you to either cancel, hold, or change the unit to another model. If you have any questions, please call us before ordering.
Out of state sales on Motor Vehicles If you buy something from us, check your local laws on what's acceptable and what's not. Some cities or states have laws saying you have sound restrictions and CARB approvals. Once you get your vehicle fill out the "MCO Form" on the left side menu of our website and we will send your MCO and appropriate registration documents for DMV registration. The customer is responcible for jetting their unit if they are over altitude of 1000 feet. All units are jetted for sea level. It is not Killer Motorsports responcibility to jet units before they leave.
Vehicle Insurance I, the customer, agree to maintain insurance on any scooter being purchased. I understand that while living in Texas, it is the law and am required to have current insurance coverage. All Fed Ex Packages are insured Automatically for the purchased value. All Freight trucks have insurance included for shipped crated units. All Car transport carriers for UTVS have insurance through the carrier. All damaged claims are handled by Killer Motorsports except for car transport carriers, those claims MUST go through the carrier. In state Sales Any Motor Vehicle (Scooters) that must be Tagged, Titled, and Registered Legally in the State of Texas MUST be registered through Killer Motorsports in Fort Worth, Texas if that vehicle is purchased from Killer Motorsports. Vehicle and Parts Warranty The 90 day manufacture warranty is provided by the manufacture, NOT Killer Motorsports and starts for a period of 90 days from the date the product is recieved. Killer Motorsports will handle all warranty claims between the manufacture and the customer. The customer agrees to follow all manufacture procedures and policies for filing a claim to warranty a product.
To file a claim you must click on the link on our left side menu that says "File A Claim". This is the ONLY way to file a Warranty Claim. The manufacture is the SOLE determiner if something is to be covered under warranty.
The 90 day manufacture warranty is through the Manufacture and is simple. 1. No Wear and Tear items are covered under warranty. Transmissions are not covered under warranty
2. The manufacture does not cover labor in any situation.
3. All warranty parts must be sent in by the customer for replacement, the manufacture will cover shipping back to the customer.
4. The warranty does not cover vehicles that are raced, modified, and not maintained properly. 5. For Extended Warranties only the motor internals are covered, no labor is covered.
Every person that buys a vehicle from Killer Motorsports needs to read the maintenance section provided by Killer Motorsports. This will explain all the maintenance that needs to be performed and will explain how to keep your vehicle in tip top shape.
All products sold by Killer Motorsports, Inc. are guaranteed to be fully functional or in working order at the time of sale by the manufacture. If the product received is not in working order or is damaged at the time of purchase or delivery, make a note of the damages to the shipper or carrier and file a warranty claim with Killer Motorsports within 24 hours of delivery. Vehicle Operation If you buy a product from us then you need to make sure you know what you are doing. We have absolutely ZERO liability if you or someone else gets hurt, injured, or killed riding a motor vehicle or part purchased from Killer Motorsports. It's up to you to maintenance your product, learn how to use it, and know how to maintain it. Assembly for shipped products All our powersports products do require some assembly. If you get a dirt bike, scooter, go kart, etc then you will have some assembly. Most assembly requires you put the tires, bars, battery, etc on.. Waiver of Liability By purchasing any items on this website, I, as buyer, acknowledge and agree to be above 18 years of age. I, as buyer, acknowledge and understand that riding an all-terrain-vehicle, Utility Vehicle, dirt bike, go kart, motorcycle, moped, pocket bike and gas scooter is a dangerous activity that requires strenuous exercise and various degrees of skill and experience for individual riders. I, as buyer, understand that these activities can result in serious injury to the person and damages to property and voluntarily assume any and all risk associated with loss, damage or injury while riding the vehicles advertised on our website. I, as buyer, am aware of the risks, hazards and dangers of personal injury, death and disability inherent with the specific use of these vehicles as well as the inherent risks, hazards and dangers of personal injury and disability increase with inexperienced riders. I, as buyer, agree to release and forever discharge Killer Motorsports or its parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf and the manufacture from any and all claims, actions, damages, liabilities, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to your participation or use of these vehicles, use of equipment or property supplied by Killer Motorsports or its parent company or your presence upon the premises , whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, manufacture or distributor. By this Agreement, it is my intention as buyer, to surrender and waive any rights to sue or exercise any legal rights to seek damages from Killer Motorsports or its parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf. This Agreement shall be affecting and binding upon my heirs, agents, personal representatives and assigns. I, as buyer, hereby certify that I am over the age of 18 years of age. I, as buyer, have carefully read the foregoing and acknowledge that I understand and agree to all the above Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the affect of the same. I, as buyer, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release certain substantial rights that I may have or possess. I, as buyer, therefore release all liability and waive all rights I may have in regards to my child's activities with any items purchased from Killer Motorsports. Legal for Products I, as buyer, agree to read the user's manual carefully before operating my vehicle. I, as buyer, agree to inspect my vehicle to be sure all nuts, bolts and chain are tight and the vehicle is safe for operations. I, as buyer, agree to wear a helmet and protective gear when riding. I, as buyer, acknowledge that it is my responsibility, to ascertain and obey all local, state and federal laws in regards to the possession and use of any items purchased from Killer Motorsports and its parent company. Killer Motorsports and its parent company will not be liable for the misuse of any products purchased from Killer Motorsports and its parent company or any of its distributors or agents. I, as buyer, have read this waiver of liability, assumption of risk and indemnity agreement, fully understand its terms, and understand that I, as buyer, am giving up substantial rights by agreeing to this waiver and have brought it freely and voluntarily without any inducement, assurance or guarantee being made to me. My purchase is to be considered as a complete an unconditional release of all liability to the greatest extent allowed by law. I understand that buying from Killer Motorsports and/or on their website that any vehicle has NO returns and NO Refunds and that I have read and will comply with our entire Terms/Agreements, Warranty, and Returns Policy. Maintenance Help Please review our maintenance page before contacting us.There is ALOT of useful information that can help you solve most simple issues. If you are having issues with your product you can either take it to Killer Motorsports Service Shop or a local certified mechanic. Shipping All Orders - Orders are processed and shipped within 5 business days from the date of purchase ( but usually 24-48 Hours ). We can email you your tracking number within 24 hours from the time your shipment leaves our warehouse so you can track your shipment en route. If your item does not ship within 5 business days, you can request to receive a full refund and cancel your order. We will contact the customer if an item is not in stock and will not be in stock to ship within 5 days of ordering.
We use a third party LTL transportation company to deliver vehicles, Car transport for large vehicles (UTV), and Fed Ex/USPS to deliver parts. LTL Transit time may take, but not limited from 2-7 business days depending on how far you are from Texas. During holiday seasons, transit time may be an additional 3-5 business days. Orders may not be canceled or refused due to extended transit schedules.
UTVS are shipped Assembled Via a Car Carrier. The unit may NOT be refused for delivery. If you get the unit and you believe there is shipping damages, this MUST be filed with the shipping company. If you get your unit and you believe you are missing something, you must file a claim with Killer Motorsports. If you get your UTV and it needs to be jetted for your altitude, call our service techs or visit our maintenance section at www.killermotorsports.com . Once the unit is assembled at our dealership and a Full PDI Checklist is performed, the unit may not be refunded or returned. Lost or Shipping Damages We pack everything and test it before it leaves our warehouse. We do this so if you get a crate and it is damaged, then the fault lies with the shipping company. If you get a product from us, then you have to let us know about the damage within 2 days of receiving it. Products may not be refused for delivery under any circumstance or you, the buyer, will be responsible for shipping to and from our warehouse as well as return fees and an additional 20% restocking fee. Sometimes a unit will receive cosmetic damage while in transit from the shipping company, 99% of the time it is just a piece of plastic here or there and we will file a claim with the shipping company and send your new parts out asap. Once the product has been assembled, fueled, used in any way, it WILL NOT be allowed for return for ANY reason. If a claim is not filed within the first 48 hours, I, the customer, understand Killer Motorsports does not have to accept the claim and it will be the customer’s responsibility to file a claim with the shipping company at that point for reimbursement of damages. If the claim is filed in the first 48 hours, Killer Motorsports will file the claim with the shipping company and send any damaged parts needed. If the customer orders a part and the part shows it left Killer Motorsports warehouse, the customer releases Killer Motorsports from any and all liability and/or association if the part is lost during shipping transit. If the part is lost in transit the customer needs to file a claim with the shipping company.
Free Shipping Free shipping only applies to the 48 Continental United States. Free shipping applies to ANY order over $99. Free shipping does not apply to International orders, Hawaii, Alaska, or Puerto Rico. There is an up charge in shipping because it has to go by plane instead of by freight truck. We do not ship vehicles out of the United States. Returns/Refunds Returns are simple. If you want to return a vehicle or part, it must still be in the crate/box, in new condition, and be returned within 48 hours of delivery. The customer must pay the freight back, origional shipping is not refunded, and we charge a 20% restocking fee.
Products may not be refused for delivery under any circumstance or you, the buyer, will be responsible for shipping to and from our warehouse as well as return fees and an additional 20% restocking fee.
Refunds are not processed until the product has been received into our warehouse and the paperwork has been completed. Once this is done we will issue a refund check.
