Please read this web page carefully. It contains the Terms and Conditions governing your access to and use to the Killer Motorsports webpage. If you don't like our terms and agreements, then feel free to ride on out of here!

Binding Agreement
This means that if you go to any page on our site or buy a product then you agree to the following terms and are in a binding agreement with Killer Motorsports, INC.

More Terms and Agreements
Excess Wear and Use
I agree to pay you the costs of all repairs to the Vehicle that are not the result of normal wear and use, whether or not you actually repair the vehicle. Excess wear and use includes, but is not limited to:

• Inoperative electrical or mechanical parts;
• Dented, scratched, chipped, rusted, pitted, broken or mismatched body parts, pain, vehicle identification items, trim or grill work;
• Non functioning , scratched, cracked, pitted or broken glass or lights;
• Missing equipment, parts, accessories or adornments.
• Torn, damaged, burned or stained interior;
• Any damage that makes the vehicle unlawful or unsafe to drive;
• Damage due to installation or removal of non-manufacturer, after-market or replacement parts;
• Damage ( including damage to the engine) due to failure to maintain the Vehicle in accordance with Section 15.B or;
• Tires with tread less than 1/8”, remaining at the shallowest point, or tires not all of the same grade, quantity and quality as those delivered with the vehicle.

Vehicle Insurance
I, the customer, agree to maintain insurance on any scooter being purchased. I understand that while living in Texas, it is the law and am required to have current insurance coverage.

Warranties

• No warranties by Seller. The seller makes no warranties, express or implied, about the vehicle. There are no implied warranties of merchantability or fitness for a particular purpose on this vehicle.
• Exceptions to above. The above does not apply if the seller makes a written warranty.
• No effect on manufacturer warranty, if any.   The above does not affect any warranties covering the vehicle that the manufacture or distributor of the vehicle may provide, if any.
• Use of vehicle and any related agreements. I agree.
• Not to removed the vehicle from the US.
• Not to allow the vehicle to be misused.
• Not to use the vehicle improperly.
• To promptly pay all taxes and charges on the vehicle.
• To maintain the vehicle in good condition and have the vehicle serviced and maintained in accordance with the manufacturer’s recommendations and specifications, so long as I have obligations under this contract.

Vehicle and Parts Warranty
KILLER MOTORSPORTS, INC. WARRANTY TO THEIR CUSTOMERS OR CONSUMERS FOR A PERIOD OF 12 MONTHS FROM THE DATE OF INVOICE , WHEN USED AS INTENDED AND UNDER NORMAL SERVICE AND CONDTIONS.

When filing a claim with Killer Motorsports, Inc., please send all available information including photographic evidence and a brief explanation of the damages to support@killermotorsports.com . This is the only way you can file a claim with us. There must be documentation for us to review a potential claim.

Killer Motorsports is a certified and authorized in house warranty and repair facility for every vendor we sell product for as well as our custom bikes. Anything that is filed as a claim we handle in house. Most companies are not an in house certified and authorized warranty and repair facility, so your parts must be sent to the dealer and then the dealer will send them to the manufacture for consideration for replacement. Since we are an in house certified and authorized warranty and repair facility, everything is handled by our staff. The Manufacture is the SOLE determiner if something is a warranty

The 12 Month warranty with Killer Motorsports through the Manufacture is simple.
1. No wear and tear items are covered under warranty. Period. No Exceptions. The following is a list of parts considered wear and tear.
Wear & Tear: the natural deterioration of an object due to heavy usage or age.

Every person that buys a vehicle from Killer Motorsports needs to read the maintenance section provided by Killer Motorsports. This will explain all your bike maintenance that needs to be performed and will explain how to keep your bike in tip top shape.

For 30 days the front and rear suspension will be covered by the manufacture and only for defects. These parts have heavy usage. We guarantee the bike will work 100% when you get it. Sometimes a fork seal can break. If this happens in the first 30 days you need to contact us to file a warranty claim. Follow the steps at the top of the page to file a claim. We will not cover suspension due to jumping or racing, only manufacture defect.

For 30 days the carburetor will be covered by the manufacture and only for defects. You need to make sure you keep your carburetor clean and clean your air filter. Dirt can accumulate in your carb and this needs to be cleaned. If you file a claim and send your carb to us for replacement and we find you did not clean the carb, your carb will not be covered under manufacture warranty and will be sent back. Carbs are only covered under manufacture defect.

For 365 days your Engine will be covered under manufacture defect. For the first 6 months your engine will be available for direct replacement or repair, parts and labor is included (labor by Killer Motorsports Certified Techs only). For the remaining 6 months of your 12 month warranty only engine parts will be covered, no labor is covered. For instance, if you have a seal break or need piston rings, that will be covered and you will be responsible for the install or can pay our mechanics to install those parts.
Under NO circumstances does Killer Motorsports pay for labor for warranty or shipping charges to our facility. We do pay for shipping back to you for the first claim.
(Please note: Killer Motorsports, Inc. will not cover engine damage due to transmission failure.)

All products sold by Killer Motorsports, Inc. are guaranteed to be fully functional or in working order at the time of sale. All orders are carefully inspected for quality assurance before shipping. However, any parts that have been purchased from Killer Motorsports, Inc. are not covered by this warranty. If the product received is not in working order or is damaged at the time of purchase or delivery, please make a note of the damages to the shipper or carrier. Take photographic evidence of any damages and file a warranty claim with Killer Motorsports Support Staff. Once the claim has been approved, Killer Motorsports, Inc. will ship out a replacement part free of charge. All warranty claims must be file within 48 hours from the time of receipt or delivery. If any customer or consumer is near the facility of Killer Motorsports, Inc., they may bring in their defective or damage product.

The warranty does not cover conditions resulting from negligence, loss of time, inconvenience, and loss of use of the product or any other consequential damage. This warranty also will not cover any ENGINE that have been altered or modified without written permission from Killer Motorsports, Inc.
Any damages that occur due to the misuse or improper care of the vehicle including but not limited to exceeding the weight limit, shipping damages, accidents, or gross misuse of normal intended operations are not covered under the warranty. Misuse also specifically included failure to properly maintain oil levels, grease points, and drive line shaft.
Conditions are not covered by this warranty are as followed:

REPAIR OR REPLACEMENT IS PROVIDED UNDER THIS WARRANTY IS THE EXCLUSIVE REMEDY OF THE CONSUMER. THIS WARRANTY SHALL NOT BE INTERPRETED TO RENDER KILLER MOTORSPORTS, INC. LIABLE OF ANY KIND, DIRECT, CONSEQUENTIAL, OR CONTINGENT TO PROPERTY. FURTHERMORE, KILLER MOTORSPORTS, INC. SHALL NOT BE LIABLE FOR DAMAGES RESULTING FROM ANY CAUSE BEYOND ITS REASONABLE CONTROL. THIS WARRANTY DOES NOT EXTEND TO LOSS, ANY EXPENSE OR LOSS OF LABOR, SUPPLIES, AND RENTAL MACHINERY OR FOR ANY OTHER REASON.
NO OTHER WARRANTY OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IS MADE WITH RESPECT TO THIS SALE, UNLESS STATED OTHERWISE BY KILLER MOTORSPORTS, INC. AND THEIR RESPECTED MANUFACTURERS. ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WHICH EXCEED THE OBLIGATIONS SET FORTH IN THIS WRITTEN WARRANTY ARE HEREBY DISCLAIMED AND EXCLUDED FROM THIS SALE.

If you are in the Dallas / Fort Worth area, you can feel free to bring your bike up to the shop and talk with our service techs.
If you get the part and it is not working 100%, then take pictures of the part and email a description, name, contact info, the picture(s), and your contact information to support@killermotorsports.com

Other agreements
I agree that you may delay or refrain from enforcing any of your rights under this contract without losing them. This contract contained the entire agreement between us about the sale. Any change to this contract must be in writing and both of us must sign it. No oral changed to this contract are binding. Unless the law or another part of this contract requires something different, I agree that you can give any notice to me by hand or by mailing it in the US Postal Service address to my last address shown by your records, unless I notify you in writing of a different address. I understand that Federal law and Texas law apply to this contract.

Important Limitations on your rights
All of your rights will be used only in a lawful way and without breaching the peace. I, as buyer, have carefully read the foregoing and acknowledge that I understand and agree to all the Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the affect of the same. I, as buyer, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release all legal rights that I may have or possess. I, as buyer, therefore release all liability and waive all Legal rights I may have in with any items purchased from Killer Motorsports. Any and all issues or problems will be solved in accordance to the terms specified in this contract.

Out of state sales on Motor Vehicles
If you buy something from us, check your local laws on what's acceptable and what's not. Some cities or states have laws saying you have sound restrictions and CARB approvals. If you choose to register your vehicle. Once you get your vehicle Call or email us with the VIN number and we will fill out your MSO and appropriate registration documents and send it out to you so you can go to the DMV for registration.

In state Sales
Any Motor Vehicle that must be Tagged, Titled, and Registered Legally in the State of Texas MUST be registered through Killer Motorsports in Fort Worth, Texas if that vehicle is purchased from Killer Motorsports. 

Vehicle Operation
If you buy a product from us then you need to make sure you know what you are doing.  We have absolutely ZERO liability if you or someone else gets hurt, injured, or killed riding a motor vehicle or part purchased from Killer Motorsports. It's up to you to maintenance your product, learn how to use it, and know how to maintain it.

Holding Units
We can only hold units if a 25% deposit is put down. We can then only hold the unit for 48 hours. If the unit is not picked up within 48 hours and paid in full we have the right to refund the deposit and sell the unit. We will NOT hold a unit unless a deposit is put down.

Colors
We try and do a good job of describing the colors and what the bikes look like. Sometimes we are out of one color so that is why we ask for an alternate color. In case we are out of that color we can get you another color and still get your bike out to you! If for whatever reason we do not have the alternate color we will contact you with further options.

Changes and Inaccuracies
We are constantly improving our website and catologes and are always striving to get the best descriptions made that are 100% accurate as well as current pictures. Sometimes we do get some bad information from the manufacture. We will in NO WAY PERIOD refund money or accept returns for inaccuracies. If you are buying something on the internet and are concerned the description could be wrong, we have a full staff that can answer questions via email, phone, or at the shop in person before you buy. You, the customer, acknowledges this and agrees to these terms and agreements as stated.

Privacy Policy
We do not sell or share any information we receive from customers. When you buy something from Killer Motorsport, you can opt to be included in OUR mailing list for promotional mailers and emails.

Assembly for shipped products
All our power sports products do require some assembly. If you get a dirt bike, scooter, go kart, etc then you will have some assembly. If you get a dirt bike then typical assembly will mean mounting the front tire, handlebars, and footpegs. If you get an atv you have to usually put on the front fender, lights, battery, handlebars, and tires. If you get a scooter you have to put on the front tire, mirrors, windshield, and handlebars. If you get a go kart you have to assemble the seat, gas tank, brace bars and tires. Click here for general pit bike assembly instructions. For any warranty to be void, you must have this assembly work completed by a certified mechanic. I, the customer, agree to this.

Waiver of Liability
By purchasing any items on this website, I, as buyer, acknowledge and agree to be above 18 years of age. I, as buyer, acknowledge and understand that riding an all-terrain-vehicle (ATV), dirt bike, go kart, motorcycle, moped, pocket bike and gas scooter is a dangerous activity that requires strenuous exercise and various degrees of skill and experience for individual riders. I, as buyer, understand that these activities can result in serious injury to the person and damages to property and voluntarily assume any and all risk associated with loss, damage or injury while riding the vehicles advertised on our website. I, as buyer, am aware of the risks, hazards and dangers of personal injury, death and disability inherent with the specific use of these vehicles as well as the inherent risks, hazards and dangers of personal injury and disability increase with inexperienced riders. I, as buyer, agree to release and forever discharge Killer Motorsports or its parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf and the manufacture from any and all claims, actions, damages, liabilities, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to your participation or use of these vehicles, use of equipment or property supplied by Killer Motorsports or its parent company or your presence upon the premises , whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, manufacture or distributor. By this Agreement, it is my intention as buyer, to surrender and waive any rights to sue or exercise any legal rights to seek damages from Killer Motorsports or its parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf. This Agreement shall be affecting and binding upon my heirs, agents, personal representatives and assigns. I, as buyer, hereby certify that I am over the age of 18 years of age. I, as buyer, have carefully read the foregoing and acknowledge that I understand and agree to all the above Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the affect of the same. I, as buyer, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release certain substantial rights that I may have or possess. I, as buyer, therefore release all liability and waive all rights I may have in regards to my child's activities with any items purchased from Killer Motorsports.

Legal for Products
I, as buyer, agree to read the user's manual carefully before operating my vehicle. I, as buyer, agree to inspect my vehicle to be sure all nuts, bolts and chain are tight and the vehicle is safe for operations. I, as buyer, agree to wear a helmet and protective gear when riding. I, as buyer, acknowledge that it is my responsibility, to ascertain and obey all local, state and federal laws in regards to the possession and use of any items purchased from Killer Motorsports and its parent company. Killer Motorsports and its parent company will not be liable for the misuse of any products purchased from Killer Motorsports and its parent company or any of its distributors or agents. I, as buyer, have read this waiver of liability, assumption of risk and indemnity agreement, fully understand its terms, and understand that I, as buyer, am giving up substantial rights by agreeing to this waiver and have brought it freely and voluntarily without any inducement, assurance or guarantee being made to me. My purchase is to be considered as a complete an unconditional release of all liability to the greatest extent allowed by law. I understand that buying from Killer Motorsports and/or on their website that any vehicle has NO returns and NO Refunds and that I have read and will comply with our entire Terms/Agreements, Warranty, and Returns Policy.

Maintenance Help
Please review our maintenance page before contacting us. There is ALOT of useful information that can help you solve most simple issues. If you are having issues with your product you can either take it to Killer Motorsports Service Shop or a local certified mechanic.

Shipping
All Orders - Orders are processed and shipped within 5 business days from the date of purchase ( but usually 24-48 Hours ). We can email you your tracking number within 24 hours from the time your shipment leaves our warehouse so you can track your shipment en route. If your item does not ship within 5 business days, you can request to recieve a full refund and cancel your order. Sometimes items will not be in stock and will go on backorder while waiting for the restocking shipment from the manufacture; we will contact the customer if an item is not in stock and will not be in stock to ship within 5 days of ordering.

We use a third party LTL transportation company to deliver vehicles and Fed Ex ONLY to deliver parts. Transit time may take, but not limited from 2-7 business days depending on how far you are from Texas. During holiday seasons, transit time may be an additional 3-5 business days. Order may not be canceled or refused due to extended transit schedules.

Lost or Shipping Damages
We pack everything and test it before it leaves our warehouse. We do this so if you get a crate and it is damaged, then the fault lies with the shipping company. If you get a product from us, then you have to let us know about the damage within 2 days of receiving it. If you want to refuse the product BECAUSE of damage, the product must be in original packaging and not used in ANY way.  Once the product has been assembled, fueled, used in any way, it WILL NOT be allowed for return for ANY reason. If you accept the product, you agree to legally take possession of the unit.  If there are minor defects, plastics broken, flat tire, etc then you MUST notify us within 48 hours of receiving the product and you MUST take pictures of the box, product, damaged parts and send an email with your name, order number, contact information, and pictures to support@killermotorsports.com. If this is not done within the first 48 hours, I, the customer, understand Killer Motorsports does not have to accept the claim and it will be the customer’s responsibility to file a claim with the shipping company at that point for reimbursement of damages. If the claim is filed in the first 48 hours, Killer Motorsports will file the claim with the shipping company and send any damaged parts needed. If the customer orders a part and the part shows it left Killer Motorsports warehouse, the customer releases Killer Motorsports from any and all liability and/or association if the part is lost during shipping transit. If the part is lost in transit the customer file a claim with the shipping company.

Free Shipping
Free shipping only applies to the 48 Continental United States. Free shipping applies to ANY order over $199. Free shipping does not apply to International orders, Hawaii, Alaska, or Puerto Rico. There is an up charge in shipping because it has to go by plane instead of by freight truck. We do not ship vehicles out of the United States.

Returns/Refunds
Custom Bikes - Any Custom Bikes that are custom built become the customers once custom work is started. There are NO RETURNS and NO REFUNDS on custom bikes for any reason. If there are any problems with the bike upon receiving the bike we will work with the customer to make the bike 100%.

Pit Bikes, Scooters, Go Karts - There are absolutely no refunds or returns allowed for any items that are assembled, used or fueled, or registered for any reason as the vehicle would be considered used. If you get a product and you believe it is damaged, you can either refuse delivery and we can send out another model, or you can accept the product and we can send out any cosmetic parts needed to fix the unit. You have 48 hours to inform us of any damage via shipping. There are NO returns on malfunctioning units. If there is a malfunction upon receiving the unit, we will work with the customer and send any parts needed to make the unit 100%. Any malfunctions must be reported within 36 hours of receiving the product.

Parts - All items are brand new sealed in manufacture's packaging. There are no returns on Parts, period. If you get the part and it was damaged in shipping. Take a picture and send an email with your name, contact information, and picture to support@killermotorsports.com and someone will contact you for replacement or repair within 24 hours or within normal business hours.
Order may be canceled only if we are unable to fulfill and ship your order within 5 business days. You may also cancel your order if your item has not been shipped. However you will be charged a 5% fee if you are still within the 5 day period.

Once your order ships, you may not cancel your order. If you refuse to accept a delivery for a shipment for any reason other than Extreme Damage, you agree to pay all shipping costs to and from Killer Motorsports and a 30% restocking fee for that product. All sales are final. If any product is refused for damage the customer MUST have the driver and shipping company note on the paperwork that the item was refused because of damage. If the customer does not have this done, the above “fees” statement will in fact apply.

Parts may be returned and/or exchanged less the shipping fee and 30% restocking fee for the parts. Parts must be in 100% working, unused/resalable condition, and still in the original box. Parts can not be returned if mounted or used. Parts that need to be returned must have an RMA number and the request placed 48 hours after delivery.

Refunds are not processed until the parts have been received into our warehouse and the paperwork has been completed. Once the paperwork is complete and parts received, we will either credit your Paypal, Credit card, or issue a refund check.

Security

Our website uses Secure Sockets Layering (SSL) with 512bit encryption. We are also covered by Volusion 256bit SSL Security Protection. It's pretty much impossible anyone would be able to get your information.
